Events and Legacy of the Amistad Case of 1840 While it began more than 4,000 miles from the jurisdiction of the U.S. federal courts, the Amistad Case of 1840 remains one of the most dramatic and meaningful legal battles in America’s history. More than 20 years before the start of the Civil War, the struggle of 53 enslaved Africans, who after violently freeing themselves from their captors, went on to seek their freedom in the United States highlighted the growing abolitionist movement by turning the federal courts into a public forum on the very legality of slavery. The Enslavement In the spring of 1839, traders in the Lomboko slave factory near the West African coastal town of Sulima sent more than 500 enslaved Africans to then Spanish-ruled Cuba for sale. Most of the slaves had been taken from the West African region of Mende, now a part of Sierra Leone. At a slave sale in Havana, infamous Cuban plantation owner and slave trader Jose Ruiz bought 49 of the enslaved men and Ruiz’s associate Pedro Montes bought three young girls and a boy. Ruiz and Montes chartered the Spanish schooner La Amistad (Spanish for â€Å"The Friendship†) to deliver the Mende slaves to various plantations along the Cuban coast. Ruiz and Montes had secured documents signed by Spanish officials falsely affirming that the Mende people, having lived on Spanish territory for years, were legally owned as slaves. The documents also falsely anointed the individual slaves with Spanish names. Mutiny on the Amistad Before the Amistad reached its first Cuban destination, a number of the Mende slaves escaped from their shackles in the dark of night. Led by an African named Sengbe Pieh – known to the Spanish and Americans as Joseph Cinquà © – the escaped slaves killed the Amistad’s captain and cook, overpowered the rest of the crew, and took control of the ship. Cinquà © and his accomplices spared Ruiz and Montes on the condition that they take them back to West Africa. Ruiz and Montes agreed and set a course due west. However, as the Mende slept, the Spanish crew steered the Amistad northwest hoping to encounter friendly Spanish slaving ships headed for the United States. Two months later, in August 1839, the Amistad ran aground off the coast of Long Island, New York. Desperately in need of food and fresh water, and still planning to sail back to Africa, Joseph Cinquà © led a party onshore to gather supplies for the voyage. Later that day, the disabled Amistad was found and boarded by the officers and crew of the U.S. Navy survey ship Washington, commanded by Lieutenant Thomas Gedney. The Washington escorted the Amistad, along with the surviving Mende Africans to New London, Connecticut. After reaching New London, Lieutenant Gedney informed the U.S. marshal of the incident and requested a court hearing to determine the disposition of the Amistad and her â€Å"cargo.† At the preliminary hearing, Lieutenant Gedney argued that under admiralty law – the set of laws dealing ships at sea – he should be granted ownership of the Amistad, its cargo and the Mende Africans. Suspicion arose that Gedney intended to sell the Africans for profit and had, in fact, chosen to land in Connecticut, because slavery was still legal there. The Mende people were placed in the custody of the United States District Court for the District of Connecticut and the legal battles began. The discovery of the Amistad resulted in two precedent-setting lawsuits that would ultimately leave the fate of the Mende Africans up to the U.S. Supreme Court. Criminal Charges Against the Mende The Mende African men were charged with piracy and murder arising from their armed takeover of the Amistad. In September 1839, a grand jury appointed by the U.S. Circuit Court for the District of Connecticut considered the charges against the Mende. Serving as the presiding judge in the district court, U.S. Supreme Court Justice Smith Thompson ruled that the U.S. courts had no jurisdiction over alleged crimes at sea on foreign-owned vessels. As a result, all criminal charges against the Mende were dropped. During the circuit court session, abolitionist lawyers presented two writs of habeas corpus demanding that the Mende be released from federal custody. However, Justice Thompson ruled that due to the pending property claims, the Mende could not be released. Justice Thompson also noted that the Constitution and federal laws still protected the rights of slave owners. While the criminal charges against them had been dropped, the Mende Africans remained in custody because they were still the subject of multiple property claims for them pending in the U.S. district court. Who ‘Owned’ the Mende? Besides Lieutenant Gedney, the Spanish plantation owners and slave traders, Ruiz and Montes petitioned the district court to return the Mende to them as their original property. The Spanish government, of course, wanted its ship back and demanded that the Mende â€Å"slaves† be sent to Cuba to be tried in Spanish courts. On January 7, 1840, Judge Andrew Judson convened the Amistad case trial before the U.S. District Court of in New Haven, Connecticut. An abolition advocacy group had secured the services of attorney Roger Sherman Baldwin to represent the Mende Africans. Baldwin, who had been one of the first Americans to interview Joseph Cinquà ©, cited natural rights and laws governing slavery in Spanish territories as reasons the Mende were not slaves in the eyes of U.S. law. While U.S. President Martin Van Buren at first approved the Spanish government’s claim, Secretary of State John Forsyth pointed out that under the constitutionally mandated â€Å"separation of powers,† the executive branch could not interfere with the actions of the judicial branch. In addition, noted Forsyth, Van Buren could not order the release of the Spanish slave traders Ruiz and Montes from prison in Connecticut since doing so would amount to federal interference in the powers reserved to the states.   More interested in protecting the honor of his nation’s Queen, than the practices of American federalism, the Spanish minister argued that the arrest of Spanish subjects Ruiz and Montes and the seizure of their â€Å"Negro property† by the United States violated the terms of a 1795 treaty between the two nations. In light of the treaty, Sec. of State Forsyth ordered a U.S. attorney to go before the U. S. District Court and support Spain’s argument that since a U.S. ship had â€Å"rescued† the Amistad, the U.S. was obligated to return the ship and its cargo to Spain. Treaty-or-not, Judge Judson ruled that since they were free when they were captured in Africa, the Mende were not Spanish slaves and should be returned to Africa. Judge Judson further ruled that the Mende were not the private property of the Spanish slave traders Ruiz and Montes  and that the officers of the U.S. naval vessel Washington were entitled only to the salvage value from the sale of the Amistad’s non-human cargo.   Decision Appealed to U.S. Circuit Court The U.S. Circuit Court in Hartford, Connecticut, convened on April 29, 1840, to hear the multiple appeals to Judge Judson’s district court decision. The Spanish Crown, represented by the U.S. attorney, appealed Judson’s ruling that the Mende Africans were not slaves. The Spanish cargo owners appealed the salvage award to the officers of The Washington. Roger Sherman Baldwin, representing the Mende asked that Spain’s appeal should be denied, arguing that the U.S. government had no right to support the claims of foreign governments in the U.S. courts. Hoping to help speed the case ahead to the Supreme Court, Justice Smith Thompson issued a brief, pro forma decree upholding Judge Judson’s district court decision. The Supreme Court Appeal Responding to pressure from Spain and growing public opinion from the Southern states against the federal courts’ abolitionist leanings, the U.S. government appealed the Amistad decision to the Supreme Court.   On February 22, 1841, the Supreme Court, with Chief Justice Roger Taney presiding, heard opening arguments in the Amistad case. Representing the U.S. government, Attorney General Henry Gilpin argued that the 1795 treaty obligated the U.S. to return the Mende, as Spanish slaves, to their Cuban captors, Ruiz and Montes. To do otherwise, Gilpin warned the court, could threaten all future U.S. commerce with other countries. Roger Sherman Baldwin argued that the lower court’s ruling that the Mende Africans were not slaves should be upheld. Aware that a majority of the Supreme Court justices were from Southern states at the time, the Christian Missionary Association convinced former President and Secretary of State John Quincy Adams to join Baldwin in arguing for the Mendes’ freedom. In what would become a classic day in Supreme Court history, Adams passionately argued that by denying the Mende their freedom, the court would be rejecting the very principles upon which the American republic had been founded. Citing the Declaration of Independence’s acknowledgment â€Å"that all men are created equal,† Adams called on the court to respect the Mende Africans’ natural rights. On March 9, 1841, the Supreme Court upheld the circuit court’s ruling that the Mende Africans were not slaves under Spanish law and that the U.S. federal courts lacked the authority to order their delivery to the Spanish government. In the court’s 7-1 majority opinion, Justice Joseph Story noted that since the Mende, rather than the Cuban slave traders, were in possession of the Amistad when it was found in U.S. territory, the Mende could not be considered as slaves imported into the U.S. illegally. The Supreme Court also ordered the Connecticut circuit court to release the Mende from custody. Joseph Cinquà © and the other surviving Mende were free persons. The Return to Africa While it declared them free, the Supreme Court’s decision had not provided the Mende with a way to return to their homes. To help them raise money for the trip, abolitionist and church groups scheduled a series of public appearances at which the Mende sang, read Bible passages, and told personal stories of their enslavement and struggle for freedom. Thanks to the attendance fees and donations raised at these appearances, the 35 surviving Mende, along with a small group of American missionaries, sailed from New York for Sierra Leone in November 1841. The Legacy of the Amistad Case The Amistad case and the Mende Africans’ fight for freedom galvanized the growing U.S. abolitionist movement and widened the political and societal division between the antislavery North and the slave-holding South. Many historians consider the Amistad case to be one of the events that led to the outbreak of the Civil War in 1861. After returning to their homes, the Amistad survivors worked to initiate a series of political reforms throughout West Africa that would eventually lead to the independence of Sierra Leone from Great Britain in 1961. Long after the Civil War and emancipation, the Amistad case continued to have an impact on the development of African-American culture. Just as it had helped lay the groundwork for the abolition of slavery, the Amistad case served as a rallying cry for racial equality during the modern Civil Rights movement in America.

Remember tell us of a story of a female who is in an impossible relationship that is so bad that she seems to think that her only escape is suicide. She writes to her partner telling him not to grieve for her. The line Better by far you should forget and smile Than that you should remember and be sad. Shows us that she, in a way, doesnt want her partner to be sad. This is kind of hypocritical of this poem. She tells us that she doesnt have another choice to get out of this bad relationship and yet she doesnt want him to suffer. She is obviously a very kind person which makes me feel all the more emotive towards her. Remembrance is telling us a story of a girl who has lost a very dear person to death and we find her pondering suicide herself. This narrator has dug herself a hole in that thinking that she has no point in life anymore without the loved one. She must feel that she cannot go on without said person. Like many people who lose someone dear, she has lost her sense of enthusiasm for life so she, like the narrator in Remember, sees suicide as an escape from a life without a certain person. I can feel her pain, being a person who has lost someone dear to me, I went through a stage of my life where I didnt want to do anything. I didnt even want to go outside. But I am just glad that it did not get to the point where I considered suicide. When writing these poems each woman must have had to dig deep down into their feelings to create such emotive poems. Christina Rossettis father died in 1854, this could have been a very big inspiration for her to bring up so many emotions when writing such a poem. Emily Brontà ¯Ã‚ ¿Ã‚ ½ Also lost her mother which is a very good source of emotions to write with. Each writer has had some experience with death which might be the reason why the only thing they can see as a solution is death itself. They might choose to follow their parents and die. Christina Rossetti uses images such as the silent land which suggests an empty after life where as Emily Brontà ¯Ã‚ ¿Ã‚ ½ uses images such as days of golden dreams which refers to memories that were very dear to her and reminds us that those memories were lost when her loved one died. Each author was very descriptive in their imagery and it was very effective in each poem The layout of Remembrance is much easier to understand than the sonnet structure of the other one. A poem being in stanzas makes it much easier for the reader to read and work out the story behind the poem. I found it much harder to understand Remember as it was in sonnet form (14 lines). A poem being all squashed together makes it had to differentiate one line from the other. My personal preference between these to poems for the one than appeals to me in the emotive way would have to be Remembrance as I can relate to the kind of pain the narrator is going through. The writer has used such emotive language and really made the effort to connect with her own feelings which is a very hard thing to do. And to write them down and make them make sense is a type of magic in itself. A poet is, before anything else, a person who is passionately in love with language. Poetry is language at its most distilled and most powerful and this poet understands that and has somehow tapped into her own language and written her very thoughts down. So on that note I conclude that Remembrance makes the most powerful appeal to my emotions.

Marc Reisner's Coming Undammed A dam is a barrier constructed across a waterway to control the flow or raise the level of water. (Dictionary 1) They are put in place with much care and patience. A dam is very carefully planned out. Where they are going to be placed? What type of soil it is going to be constructed in? When the plans are drawn out, every detail is gone over with a fine tooth comb. Marc Reisner has written an essay titled Coming Undammed, is an essay about him talking how he supports dam removals across the country. He has made some ideas about why he sustains his opinion, some of which I agree with, but mainly I oppose. He starts off by talking about a dam that he had visited on the Elwha River, which has two dams within it. In the upper part of the river, the Glines Canyon dam, and in the lower dam just called the Elwha. His first point against the building of dams is how the silt in the ground surrounding this dam has begun to leak into the dam. Which he says will lead to big slurrying of the water and will eventually â€Å"add millions of dollars to the cost of decommissioning.† (Reisner 382) This may be the case, but is only the case in this instance that he has come across. The ground of all other dams is not made up of the same material as every other dam in the nation. The dirt in New York doesn’t have the same makeup as the dirt of the Hoover dam in Nevada. The next idea that he had for opposing dams are the expunging of fisheries where the dams are. He gave the example of how â€Å"before the dams went in, the Elwha River churned out salmon as the Chesapeake Bay did crabs.† (Reisner 382) He also goes on to say that the fish were large and there were several types of fish with in the river. He concludes this point by saying that when the dams were built up, it shut off the fish habitation within the river and reducing the fish numbers. I agree that with him that the number of fish would be decreased with a dam being built. I think that the amount wouldn’t be that high to cause a major problem.

Creative Response: Clueless

I could tell Tai’s grieving period would be considerable, unless I found someone to take Elton’s place right away. The next day in class a new guy named Christian came into my class and he was hot. Okay, okay I know I said I would find a guy for Tai, but I suppose there’s no harm in finding one for myself also. During the next few weeks I did what any normal girl would do. I sent myself love letters, flowers and candy. Just so he’d see how desired I was. Just in case he didn't already know. You also have to show a little skin.This makes them think of you naked which makes them think of sex. I invited Christian to a party and we danced all night long. Maybe too long. I could tell he was falling in love with me you know, like he even ignored every other girl that night. Diary Entry 2 Christian and I spend all of our time together. We even went shopping together, which was a plus because I wouldn’t have to find Tai or Dionne every time I had a fashion emergency. I would never be caught alone shopping. I mean could you imagine me, shopping alone? How embarrassing would that be right?Diary Entry 3 Even though I never pay that much attention to those beneath me, Travis the skateboarding pothead had been coming up in many conversations around me. I decided I would investigate the matter. So I asked Tai what everyone was doing. I mean they were talking about baloney head Travis! Tai told me that Travis won like some massive skateboarding competition and has like five sponsors now. She said that he is practically famous. What is wrong with people these days? Thinking that skateboarding is a great enough skill to make a person become famous.Please, I could do better things in my sleep. Diary Entry 4 It’s been four weeks since I found out about Travis and his new found fame and to be perfectly honest I thought it was going to be his fifteen minutes of fame but that’s not how it has turned out. Everyone has been talking abou t him and almost all the attention has gone from me and onto to him. What is so great about him anyway? He does a few tricks on a plank of wood with wheels on it, big deal. I don’t know why everyone is so hyped up about him. I mean today I saw a freshman with a picture of him in her locker!I was all like get real he is just the same old pothead he was a month ago. ? Anyway back to me. It’s been a month and Christian still hasn't made a move on me. I'm not ugly, I've been checked by a doctor for that. There must be something wrong with him because I know it’s not me. I would talk to Tai about it but she seems angry at me for some reason. I suspect it’s because I promised to find her a guy and I still haven’t, but I mean it’s really hard. I have to pay attention to my love life first right, and I can’t talk to Dionne about it, she has her own relationship problems.Plus I think she has been dragged into the Travis fandom anyway, and who wants to hear about Travis all day? Not me! Diary Entry 5 I am seriously concerned that this whole Travis thing is not a phase. I heard someone say in gym class that he doesn’t even come to school anymore. He just gets paid to skate all day and the teachers are fine with it. How can all the teachers just let something like this happen to me? Especially Miss Geist and Mr Hall. After all I have done for them they should be letting me do whatever I want, not Travis. What has he ever done for them?I’m sick of my school not paying attention to me, and let alone my supposed friends Tai and Dionne. He should really be less selfish. Diary Entry 8 I spoke to Travis about my situation and because he now knows how selfish he was being he has decided to help me, on the condition that I think less about helping myself and think more about other people. She forgets about her friends and while she is distracted by Christian, Cher loses all her popularity to the newly famous pro skater Travis. After a while Cher loses interest in Christian and realises she has lost her friends and her high status.She asks Travis to help her win her popularity back. Travis helps her become less selfish and Cher’s friends forgive her and take her back. Cher then falls for Travis. In Clueless Cher does not learn any lessons and does not realise that the way she acts is selfish and unkind. Cher gets her own way and never learns that there are consequences for her actions. The alternate ending I have written teaches Cher not to j udge a book by its cover and that everyone does not always like the way she treats them. Travis teaches her to be less selfish and Cher discovers how much she actually likes him.

As I Lay Dying (book) Essay

The character Addie Bundren is portrayed in many ways throughout the novel As I Lay Dying. The whole story revolves around the fact that Addie is dead and her wish to be buried near her blood relatives rather than her own family. The impression the reader gets of Addie is developed through many different characters’ views and descriptions of Addie. One character that helps us understand Addie’s personality a little more is Cora Tull. Cora Tull, Vernon Tull’s wife, expresses Addie’s voice and personality through her memories of Addie. Cora stood with Addie during her final hours. Cora disapproves of Addie’s behavior and lack of religion. Cora dislikes the fact that Addie’s love for Jewel is greater than her love of God. Another character that helps us understand Addie is Minister Whitfield. Addie had an affair with the minister and had a baby. This affair shows how Addie sees marital love and motherhood as empty concepts and are just there to fill empty voids. Addie doesn’t have an affair with the minister solely on lust, but she does it for self-gratification and self-expression also. Vardaman, the youngest of the Bundren children, compares his mother’s death to a fish he recently caught and cleaned. Vardaman compares his mother to a fish because the fish and his mother have both died. The fish and his mother have changed because of death. Both Addie and the fish no longer have essence, which could be interpreted as an existentialist view. In a chapter where Addie seemingly speaks from the dead, Addie’s personality is truly shown. We learn that Addie is a pessimistic and unfulfilled woman, who marries her ignorant husband Anse. She admits to only caring for two of her children and the rest she calls or labels as â€Å"Anse’s children†, who were born out of an obligation. Addie’s personality is put together by the views, comparisons, and descriptions of her youngest son Vardaman, her neighbor Cora Tull, The affair she had with Minister Whitfield, and her own personal voice. Through these views, we could conclude/interpret that Addie was a strong-willed and intelligent woman who dislikes the obligations put on women during that time period. Cora Tull shows her as some who lacks religion. The affair with the minister shows that she is a woman who needed gratification. Her youngest son shows how she is a mother who was completely lost in death and no longer has essence. Her own voice shows that she is a person who feels like women are obligated to fit into the roles of being a mother and a wife.

budget cuts essays Id like to inform you about the great deal of budget cuts happening everyday in our public school systems. One of the hardest hit is in our arts and music departments. The battle over NEA funding and other important foundations that are set up to benefit our youths are being challenged by the government at an alarming rate. Cutbacks in our schools budget force students in these departments to go without necessary supplies that are essential in the learning process. Id also like to show you why art and music education is essential to our childrens learning process, how it allows them to grow up to be well rounded citizens, and why as a country, we need to fight to save these programs. It seems to be a continuous battle for art and music educations demand for some respect. Many legislators feel the problem in our schools is that budgets where not amended to fit the rise of costs in our economy. And because of this there simply arent simple ways to fund these programs. Other reasons for problems in the arts and music departments budget is that even though there is inadequate funding schools pass programs without promise of long-term support. Thus, creating a cycle of budget problems. This is our problem. One particular agency, out of many, the NEA is facing problems that are similar to most in the art and music debates. The conservatives are pressing the case that, in the time of tight federal budgets, taxpayers cannot afford funding for the agency, which received a $99 million appropriation for fiscal 1997. The critics also argue that the agency continues to fund pornographic and blasphemous projects.(Freedman,p.624) As stated by Allan Freedman of Government and Commerce magazine, sums up the views some government officials are having concerning the NEA, an organization set up to benefit those in the art community. By extension, gospel may refer to the entire body of religious doctrine taught by Jesus Christ and the apostles. The word is also used to refer to all the books of the New Testament, or even to all 66 books in both testaments, from Genesis to Revelation. In a broader sense, any heavenly revelation may be called a gospel: God writes the Gospel not in the Bible alone, but also on trees, and in the flowers and clouds and stars. –Martin Luther. A gospel may be any secular philosophy that serves as a guide to human conduct. A doctrine or opinion that is strongly held and preached with a religious fervor is also referred to as a gospel.
